A viral video posted to Facebook on Monday shows a 9-year-old child being tattoed
The video received over 200,000 views within ten hours of being posted
Ohio does not have an age restriction for tattoos with a parental guardians permission
Performing tattoos outside of an establishment not approved by the state is prohibited
A disturbing viral video on Facebook shows a young boy receiving a tattoo on one of his shoulders. The child appears to be receiving the tattoo inside a residence and not at a licensed tattoo shop.
Storm Harrington posted the video to her Facebook on Monday evening. In the 10 hours since it was posted it has received over 221,000 views and been shared over 3,500 times. In the caption for the video, Harrington asks if the child Skylar is 9-years-old.

Others concerned by the video have pointed out the child is too young to be receiving a tattoo. However, the incident occurred in Ohio, where state law says there are no age restrictions for a tattoo as long as a parental guardian is giving consent.
Ohio Rev. Code Ann. §3730.06 to 3730.08 Tattooing and Body Piercing of a Minor – It is illegal to tattoo, body pierce or pierce the ears of anyone under age 18 without the consent of the minor’s parent, guardian or custodian. Requires the consenting individual to appear in person at the business at the time the procedure is performed and sign a document that provides informed consent.
While the law says parental consent is required, which it is assumed to have been given in the video, there are other guidelines when tattooing or piercing a minor. The parent must either be present at the business, which the video does not appear to be in a licensed business. The parent must also sign a document explaining the procedure. This process was most likely skipped since, once again, it does not appear the child is inside a licensed business.
3730.06 Consent required to perform procedure on minor.
(A) No person shall perform a tattooing procedure, body piercing procedure, or ear piercing procedure with an ear piercing gun on an individual who is under eighteen years of age unless consent has been given by the individual’s parent, guardian, or custodian in accordance with division (B) of this section.
(B) A parent, guardian, or custodian of an individual under age eighteen who desires to give consent to a business to perform on the individual under age eighteen a tattooing procedure, body piercing procedure, or ear piercing procedure performed with an ear piercing gun shall do both of the following:
(1) Appear in person at the business at the time the procedure is performed;
(2) Sign a document provided by the business that explains the manner in which the procedure will be performed and methods for proper care of the affected body area following performance of the procedure.
While Nikki Dickinson is believed to be the child’s mother, in the video he is seen sitting on the lap of Justice Oyer as an unknown man performs the tattoo. The final result is what cannot even be compared to a “prison tat” of an S near the child’s shoulder.
