New Holland Police Officer Received a Hand Job During Prostitution Sting

A story on a prostitution sting by New Holland Borough Police at Angel Spa massage parlor located on the 400 block of West Main Street in New Holland, Pennsylvania claims an undercover officer received a sexual act before making an arrest.

According to FOX6 NOW, a woman known as “Jane Doe” was arrested and refused to give her name to officers. New Holland Police launched an investigation after receiving complaints from residents in the area.

According to the criminal complaint affidavit, Doe was the only occupant inside the business and had offered customers sexual acts in exchange for money. An undercover officer visited the establishment and paid Doe $40 for a massage.

The criminal complaint states at the end of the massage, Doe made a gesture simulating masturbation with her hands and asked the officer “You want?” The officer responded by asking “how much?” Doe told him it would be $20 extra.

The complaint goes on to say that Doe performed a sexual act on the officer for several minutes. Police say the undercover officer eventually notified police about the offer of a sexual act, which led to the suspect’s arrest. Police are still attempting to identify the woman who was transported to Lancaster County Prison. Police say the investigation is ongoing.

The issue of undercover police officers participating in sexual acts with prostitutes is nothing new and still lies in somewhat of a grey area. Technically, undercover officers are allowed to commit some crimes if it prevents them from being identified as a police officer. Departments across the country have argued that in prostitution stings the undercover officer needs to act as an ordinary customer would.

In 2009, the Minnesota court of appeals ruled in Minnesota v. Burkland that a conviction against a prostitute could not stand due to the outrageous behavior of the police officer responsible for catching Betsy Lou Burkland. The officer in that situation accepted a topless massage for an hour, then initiated sexual contact by fondling Burkland’s breasts. The officer then allowed her to make sexual contact by rubbing his penis while he continued rubbing her breasts. Initially, Burkland was charged with four charges related to prostitution but only convicted of one.

In Burkland’s appeal, the court turned to the United States and Minnesota Constitutions, which is meant to protect individuals from abusive government actions. In specific, recognizing violations of due process when police conduct violates “fundamental fairness, shocking to the universal sense of justice.” This due process protection is implicated only when police overinvolvement reaches a “demonstratable level of outrageousness.”

The court referred to a similar case that sided with the police. In the case of State v. Morris an officer exposed himself to a woman during a prostitution sting. The officer exposed himself after the woman instructed him to do so to prove he was not a cop. The suspect said she would not negotiate a price until the officer exposed himself to her. The court decided the officer did not violate due process rights since he was demanded to expose himself before he would be able to gather evidence necessary to charge the suspect with prostitution. Morris was later used in State v. Crist as well.

Burkland won her appeal because the court did not see the officer’s actions as necessary to gather evidence that she was committing a crime especially since the officer initiated sexual contact when he began massaging Burkland’s breasts. In the case of the Angel Spa massage parlor, police could argue the sex act was necessary since no verbal exchange was made between Doe and the officer, aside from telling him a price.
